摘 要：本篇论文从什么是行政诉讼证明标准开始论述其中包含的有行政诉讼证明标准的特质，从四个主要方面入手：灵活性与延展性、中间性、复查性、特殊性，从而表现与民事诉讼证明标准、刑事诉讼证明标准的差别。我国的行政诉讼证明标准也存在这问题，比如证明标准过于单一，行政诉讼证明标准过于严格以及行政诉讼证明标准未反映行政诉讼特有的功能。英美法系国家行政诉讼证明标准与大陆法系国家行政诉讼证明标准的内容，在比较两者的利弊分析出对我国行政诉讼证明标准的启示。行政诉讼证明标准的研究对我国司法制度的完善有着显著的意义。文章主要分为四个部分：第一部分是行政诉讼证明标准的特质，考察行政诉讼证明标准的特征还有与民事诉讼、刑事诉讼证明标准的差异；第二部分是我国行政诉讼证明标准存在的问题；第三部分是外国行政诉讼证明标准的启示；第四部分是完善我国行政诉讼证明标准的思考。91905
