摘 要 ： 信息技术的高速发展开辟了新的反腐路径。自媒体反腐是数字化环境下公民参 政议政的表现，作为一种新兴的反腐利器，已日益成为许多国家打击和预防腐败的重要手 段。自媒体反腐在我国虽然开展得轰轰烈烈，但是却遭遇缺乏法律依据、影响司法公正、 侵犯公民权利、欠缺责任追究、缺乏举报动力的困境。自媒体反腐要想走出这些困境，必 须健全法律保障体系、坚持司法独立、注重权利保护、推进网络实名制、完善举报人保护 制度，从而使得自媒体反腐能够健康、长久地发展。85749

The Legal Dilemma And The Way Out Of We-media Anti-corruption Take micro-blog For Example
Abstract：The rapid development of information technology has opened up a new path for anti-corruption。 We-media anti-corruption is the representation of citizens’ political participation under current digital environment。 As a new anti-corruption tool, we-media anti-corruption has increasingly become an important means to combat and prevent corruption in many countries。 Despite the vigorous advancement of we-media anti-corruption in China, it has also been caught in many troubles such as the lack of legal basis, the obstruction of judicial fairness, the violation of civil rights, the lack of accountability system and reporting power of the predicament。 In order to get out of these difficulties, we must improve the legal security system, adhere to the independence of the judiciary, pay attention to the protection of rights and promote the network real name system and the whistleblower protection system so that we-media anti-corruption can enjoy a healthy and long-term development。
