论权力清单制度的法制化途径

摘要：权力清单作为推动政府依法行政和治理现代化的重要内容在党的十八届三中全会上被明确提出，让行政权力在阳光下清晰明了。权力具有不可控性，在运行过程中一旦出现偏离，就会发生权力滥用、腐败等使得政府不能正确履行职能、行政效率低下的不良现象，最终导致不能充分发挥其市场机制作用。现阶段我国权力清单制度法制化的问题有：法律性质模糊、清单内容缺乏统一规范的标准、其法律程序层次不明确以及问责监督机制的欠缺等问题，相对应的笔者在此提出相关性的解决措施及实践途径。权力清单制度作为具有特殊性的规范性文件，是我国政府自我限制行政权力界限的一种自律性行为的具体表现，但基于是通过政府自律性建立的清单，毫不避免的会出现“不透明”的部分，“法无授权即禁止，对于政府而言，凡是未经法律授权许可均不得为之”。1因此，以法律法规的形式明确规定政府权力清单的制定并予以其法制化对我国建设新时期现代化法治政府至关重要。85750
