摘要：新的《行政诉讼法》在2015年5月1日开始实行，在这部新法中，对于规范性文件规定：在行政诉讼过程中，司法机关可以对规章以下的规范性文件进行审查，并向文件制定机关提出建议。这条规定虽然勾勒出了我国对行政规范性文件的司法审查制度，但是，新法却未对文件制定主体在行政诉讼中具体的法律地位作出明确规定，在制定主体不参与诉讼的情形下，法院对文件的司法审查就难以充分发挥效力，也不利于保障更多行政相对人的合法权益。92091

On the Legal Status of the Subject of Normative Documents in Administrative Litigation

Abstract: the new "administrative procedure law" 2015 began to implement in first of May。 In the new law, the provisions of normative documents in the administrative proceedings, the judicial organs can normative documents of the regulations under review, and to document the proposed formulation organ。 Although this provision outlines China's administrative normative documents of the judicial review system, but the new law has not made specific documents making subject legal status in administrative litigation is not clearly defined, in the formulation of subject participation in the proceedings of the court case, the judicial review of the documents cannot be fully effective, nor more conducive to the protection of the legitimate interests of the administrative counterpart。
