摘    要 离婚时尚未取得的知识产权收益的归属，始终是学术界乃至立法过程中关注的焦点，由于知识产权的特殊性，因其不同于一般的财产权，所以该财产收益的归属就更加难以给出合理的方案。且在我国现行的立法中对相关问题的规定甚少，对于相对复杂的知识产权收益归属采取了回避的态度。目前，只是规定在婚姻关系存续期间所得的知识产权收益为夫妻共同财产，而对于离婚时未取得经济收益的知识产权，规定为一方所有，对另一方进行适当照顾。而“适当照顾”往往在实践适用中十分无力。故本文通过对学术界目前的各个观点进行梳理和权衡利弊后提出个人观点，以期能对我国相关问题的解决有所裨益。90318

Divorce has not been achieved on the ownership of the intellectual property income, always is the focus of attention in academia and even the legislative process, due to the particularity of intellectual property rights, because its are different from general property rights, so the ownership of the property income is more difficult to give a reasonable solution。 And the related problems in our current legislation regulation, for relatively complex intellectual property gains ownership took evasive attitude。 At present, the only rules on intellectual property income during the marriage as the common property of husband and wife, and for porce has not obtained the economic benefits of intellectual property rights, rules for all, one side to the other party to take care of appropriately。 "Take care of appropriately" often in practice is very weak。 Therefore, this article through to the viewpoint of academic circles at present and put forward the personal view after weigh the pros and cons, in order to help to our country related problem。
