摘  要：在我国，合同外包在政府履行公共职能方面发挥着巨大的推进作用，赢得社会公众的肯定支持。但是在市场高度不确定下，公共服务委托代理链的双方，即购买方和提供方的道德风险下，在外包中显露出了一些问题。本文将具体介绍公共服务合同外包的现状、合同外包存在的问题，如合同外包透明度不够，政府寻租，形成管制俘获等问题。探讨相关问题的解决对策和治理机制，对于合同外包存在问题和解决机制的研究都将从制定、实施、评估三个方面展开，以便于降低双边道德风险。92451

The public service outsourcing contract governance mechanism research

—— In the perspective of principal-agent bilateral moral hazard

Abstract: In our country, contract outsourcing plays a huge role in the government's performance of public functions, and wins the public support。 But the market is highly empirical, the two sides of principal-agent chain of public service, the moral risk of the purchaser and the provider, public service outsourcing contract also revealed some problems。 This paper will introduce the specific public service contract outsourcing status quo, the problems existing in the outsourcing contract, such as outsourcing contract transparency is insufficient, government rent, the problem such as formation of regulatory capture。 This paper discusses the solution and the management mechanism of the related problem。The research on the problems and mechanisms of contract outsourcing will be conducted in three aspects, including formulation, implementation and evaluation, so as to reduce the bilateral moral hazard。
