摘要：社会转型期，我国的城市规划工作面临着复杂多元的新格局，只有与时俱进，建立符合时代要求的城市规划司法监督制度，才能适应发展的需要，保障城市规划行政权在法治的轨道上科学、健康和平稳的运行。本文从城市规划本身的性质及其司法监督的特点出发，分析了我国城市规划司法监督的困境，然后从必要性和可行性角度双向论证了城市规划司法监督建设前景，最后通过对国外城市规划司法监督机制的比较，剖析不同国家的制度架构与建设经验，以求得出对我国城市规划司法监督制度设计的初步思考与建议。71563

Dangerous driving sin the subjective fault of research

Abstract:During the period of social transition, China's urban planning work is faced with the multiple and complex new pattern. Only keeping pace with the times and establishing the judicial supervision system of urban planning which corresponds to the demands of our times can adapt to the needs of the development and guarantee that the city planning administrative power can operate scientifically, analyzing the dilemma of our country’s judicial supervision of urban planning and then demonstrating the judicial supervision of urban planning construction prospects in both way from the angle of necessity and feasibility. Finally, by comparing foreign judicial supervision mechanism of urban planning dissects the system frame and construction experience of different countries, in order to receive preliminary thinking and suggestions to our country’s judicial supervision system design of urban planning.
