摘要：互联网发展使电子商务普及，作为阿里巴巴旗下的两大商场，京东商城与天猫商城他们之间的竞争也日趋激烈，他们之间的竞争使得各大网站也频出奇招以抢占市场先机。在这一过程中，由于市场经济固有的缺陷，也就会出现一些不正当竞争行为进而扰乱了市场竞争秩序。因此，对于不正当竞争行为监管的完善以及出台相关的法律成为了亟待解决的问题。所以，不仅需要对网络经营者加强审查和对网络的监管，我国也应该尽快的出台相关法律以弥补在电子商务这一块的缺陷。70744

一、引言
