内部行政审批作为内部行政行为的一种分类，包括上级行政机关对下级的审批，或是行政机关对部门及其组成人员的审批，在中国现行行政法体系中，是和外部行政行为完全不一样的行政行为。现行的《行政许可法》、《行政复议法》、《行政诉讼法》等都适用外部关系而不适用内部关系，《公务员法》和某些地方政府的规章、决定对内部行政关系作出了规定，但对内部行政行为特别是内部行政审批规定分散且不全，实践中出现了相当多的问题。笔者拟从实务工作中存在的典型问题入手，论述我国内部行政审批法治化的必要性及可能性，并就构建内部行政审批法治化提出相应的解决措施。下面笔者将以一个例子引出本文的讨论焦点：论文网 论内部行政审批法治化:http://www.youerw.com/faxue/lunwen_200097.html
