摘要专利法规定了四种专利侵权损害赔偿金额的计算方式，即实际侵权损失、侵权所获利益、 合理许可使用费以及法定赔偿金。专利法第四次修改草案在第六十五条四种侵权损害赔偿的 计算方式基础上增加了对故意侵权的惩罚性赔偿，但在专利侵权诉讼中，对专利侵权赔偿金 额的确认还没有具体的机制。在司法实践中，赔偿金额低没有达到专利权人维护自身的合法 权益的期望，专利权人会对专利制度失去信心，抑制自主创新能力。笔者从正泰集团诉施耐 德公司的这一案例中，分析其中侵权赔偿金额的影响因素，总结为侵权主体、侵权事实、举 证能力、主观故意和专利质量这五大影响因素与赔偿金额之间的关系。基于这五项影响因素， 最后提出完善专利侵权损害赔偿制度的建议。87981

There are four methods to calculate patent infringement damages in the Patent Law,include the actual losses, benefits gained by the infringer, reasonable times of royalty and legal damages。The fourth draft of the Patent Law added punitive damages for willful infringement in article 65。However,how to assess patent infringement damages has no exact mechanism。In the judicial practice,patent owner will lose faith in patent system and restrain their capability of independent innovation just because the amount of damages can’t achieve the anticipated effect。I will quote from the case of Chint V。 Schneider,also analysis to the case to find out the effect factors of patent infringement damages。This article will summarize relations with infringement damages to infringement subject,infringement facts,proof ability,subjective intent and patent quality。Finally,based on the five effect factors, the researcher provided some proposal to improve our patent infringement damages assessment system。
