摘要工程担保是国际上投资建设领域的惯例,是防范项目风险的重要制度性措施。在我国,建立和推行担保制度已经成为建设主管部门在整顿规范建筑市场经济秩序工作中的一项重要措施,也是我国建设市场管理体制与国际惯例接轨的重要举措。工程担保属于工程保障机制的范畴，是工程合同履约风险管理的有效手段，实行工程担保可以进一步保护与工程有关的当事人的合法权益。目前国内建筑领域存在的许多问题，如工程质量、工程款拖欠等，都与承包商合同履行不良有着密切关系。为促进建设工程担保制度的落实和完善，需要尽快完善相关立法，培育专业担保市场，通过强制性担保形式保障工程建设合同的履行等。建设工程担保虽能在一定程度上保障风险管理，但在推进工程担保的实践中,仍然存在着一些不容回避的问题。针对这些问题,本文在对我国工程保证担保制度的发展背景、现状及出现的问题进行分析和研究的基础上,结合当前的国情提出了推行和完善工程保证担保制度的一些建议，并粗略指出了需要进一步研究的相关问题。50823

Abstract Engineering guarantee is an international investment practices in the field of construction, is the important institutional measures to prevent project risk. The establishment and implementation of Guarantee system in our country, has become the competent department of construction work and standardize order in the construction of market economy in an important measure, is to integrate with the international practice, the management system of construction market in China. Engineering guarantee belongs to the category of the engineering guarantee system, and is an effective means of engineering contract risk management performance, practice the engineering guarantee can further protect the lawful rights and interests of the parties relating to the project. At present many problems existing in domestic construction field, such as project quality, project payment default, bad contract has a close relationship with contractors. To promote the implementation and improvement of construction engineering guarantee system, to perfect relevant legislation as soon as possible, cultivate professional guarantee market, through the mandatory guarantee form guarantee for the implementation of the project construction contract and so on. Construction project guarantee can guarantee risk management to a certain extent, but in promoting the practice of engineering guarantee, still there are some inevitable problems. To solve these problems, based on the development of Chinese engineering assured guarantee system background, present situation and the problems on the basis of the analysis and research, combined with the current state of the push is put forward and some Suggestions to perfect the guarantee system of engineering guarantee, and rough related issues for further study are pointed out.
