摘要 ：近年来，因用人单位单方解除劳动合同所引起的劳动争议愈演愈烈。我国现行立法关于用人单位的单方解除权制度仍存在着许多不足与缺陷：法定程序的欠缺；解除事由不明确、有待细化；预告解除有关预告期的规定未作区分；经济性裁员中有关优先留用人员的规定不符合经济规律等问题。本文立足现行立法，结合我国实情，对完善现行法律制度的程序性和实质性内容提出了合理的完善建议。80289

On the right of unilateral termination of the employing unit

Abstract: In recent years, the labor dispute which is caused by the employing unit to terminate the labor contract has become more and more intense。 China's current legislation on employer unilateral rescission system still exist many deficiencies and shortcomings: lack of legal procedures; the reason for termination is not clear, needs to be refined; notice of termination of the provisions of the relevant notice period does not make a distinction; the provisions of economic layoff relating to give priority to retain personnel does not conform to the economic law。 In this paper, based on the existing legislation, combined with China's actual situation, to improve the existing legal system of procedural and substantive content of a reasonable improvement suggestions。

《劳动法》具有社会法的属性，应与时俱进不断的改善。而劳动合同的解除又是其中的重要内容之一，其中用人单位的单方解除往往是引起劳动争议的主要导火索。我国现时的就业形势严峻，而法律对用人单位的单方权益解除权的制定缺乏细化性、明确性及严谨的程序性，这极大程度影响了劳资双方的利益，不利于推动生产经营的发展且影响劳动者的生存。因此，笔者认为应结合我国实际情况，归纳总结我国用人单位单方解除权存在的不足，完善劳动合同法律制度，才能使劳动关系安定和谐的发展，更好的保障劳资各方的权益。论文网 用人单位的单方解除权:http://www.youerw.com/faxue/lunwen_93189.html
