论我国民事诉讼的证明标准

摘要：民事诉讼证明标准是指根据法律的规定，是在民事诉讼证明过程中当事人提供证据加以证明所达到的程度，也是法官对判定案件事实是否得以证明的标准力度的衡量。首先，通过证明标准的含义和对两大法系的民事诉讼证明标准的立法概况进行论述。其次，对我国民事诉讼证明标准的立法现状以及不足之处进行了简要的阐述。最后，还要把它进行有效的完善。这样不仅使我国的民事诉讼证明标准能够达到真实理想的程度，而且还要建立以高度盖然性为基本证明标准的多元化的民事诉讼证明标准体系。39549

On the Standard of Proof of Civil Procedure in China
    Abstract:The standard of proof in civil litigation is refers to according to the provisions of the law, is of proof in civil litigation parties provide evidence proved to achieve the degree, but also the judge to determine whether the facts of the case can prove standards efforts to measure. Firstly, through the standard of proof and the civil action of the two legal system, the general situation of the standard of the legislation is discussed. Secondly, the status quo of the standard of civil proof of civil litigation in China and the inadequacies of the brief. Finally, it is effective to improve it. So that not only the China's civil litigation proof standard can achieve ideal real, but also to establish with high probability for basic proof standard of the persification of the standard of proof in civil litigation system.

论我国民事诉讼的证明标准前言
    民事诉讼证明标准的含义对研究民事诉讼证明标准的问题起着非常重要的作用。我国关于对民事诉讼价值的长期探讨不仅影响我国民事诉讼证明标准的立法状况、理论建立，而且还实适了比较广泛的研究与透彻的分析。一些国外民事诉讼证明标准的有关理论也给我国学术界和司法机关提供了非常多的参考意义。然而我国的民事诉讼证明标准还没在法条中确立下来，法官在适用时倾向于形式化。法官的心证制度具有随自己心里所想的性质。陪审员不能起着重要的作用。当事人在民事搜集证据的过程中还存在很大的阻碍。为了更好建立民事诉讼证明标准的理论基础、历史基础，本文使用价值与实证分析的方法进行论证。经过对两大法系证明标准的立法比较分析，可以探讨我国民事诉讼证明标准适用过程中的实然情况，来为我国民事诉讼证明标准的正确适用提供一点有益的理论支持。论我国民事诉讼的证明标准:http://www.youerw.com/faxue/lunwen_39881.html
