摘要随着我国正式的《中华人民共和国反家庭暴力法》出台，反家庭暴力进入了一个依法治理的新阶段。文章明确了家庭暴力的定义，分析了家庭暴力具有普遍性、隐蔽性、反复性、严重性的特征。综合分析了英国、美国、德国、挪威的相关立法，总结其具有综合立法与单项立法相结合，司法执行力强的优点。再对比我国反家暴法，分析我国立法特色与不足，提出了要进一步明确家庭成员的定义、增加性暴力为家庭暴力的方式，以及着重加强反家暴普法宣传教育、完善司法介入机制、设立专门的家事法庭、加大社会救济力度等建议。87786

Title    The Legal Regulation of Domestic Violence                     

Abstract Along with the publics of Anti-domestic Violence Law of the People's Republic of China, anti-domestic violence has entered a new stage。 This article clarifies the definition of domestic violence and analyses the characteristics of domestic violence, such as universality, concealment, repetitive and severity。 Beside on the relevant legislation of United Kingdom, the United States, Germany, and Norway, which have a complete legislation system with comprehensive legislation and special legislation and have strong executable force，paper summarizes features and shortcomings of legislation against domestic violence law。 This paper thinks that we should propose to further clarify the definition of family members, increased sexual violence as a way of domestic violence, and focus on strengthening the view of anti-domestic violence and education, improving judicial intervention mechanism, the establishment of specialized family courts, and increase the social relief efforts。
