摘要近年来，房地产在中国迅速发展，房产价格迅速扩张涨价，中国传统以家为本的观念使许多人不惜代价也要拥有属于自己的房子。因此建设在农村的小产权房由于价格远低于五证齐全的商品房而大受欢迎。但是，小产权房没有完整的产权，存在许多权利隐患，尤其是流转问题。在此，笔者将从我国小产权房产生、演变的背景进行剖析以及对小产权房流转的现状进行整理和论述，从而达到对小产权房流转所面临的法律问题的剖析目的，并对如何理顺小产权房流转的各项制度措施提出自己的一些意见和建议。87834

Abstract In recent years, with the rapid development of real estate in China, the real estate priceexpands rapidly, Because of the Chinese traditional ideas based on home, many people want to have their own house at all costs。 Therefore, the small propertyhouses in the rural areas are very popular,because the price is far lower than the commercial houses with 5 complete certificates。 。 However, there is no complete property rights of small property right house。 So there are many hidden dangers, especially the transfer problem。This article analyzes the historical reasons for the formation of the small property housein China,and summarizes the current situation of the circulation of small property house,so as to achieve the aim to analyzethe legal issues caused by the circulation of small property house。 At the end, this articleputs forward some suggestionson how to rationalize the systems and measures of the circulation of small property house。

1 引言
“小产权房”并非一个专有的法律名词，而是相比较于大产权房而形成的名词。由于房地产的迅速发展，房产价格涨了又涨，虽然国家和地方都相继出台限购、稳定房价、建设保障性住房等政策来抑制房价过快上涨，但是全国各地房地产价格一直居高不下。房子作为在国人观念中家的重要组成部分，很多人不惜花去一生积蓄只为有一套房子，甚至为此债台高筑！这种需求促成了小产权房市场的崛起和壮大，而现有的法律明确禁止小产权房及其流转，使小产权房流转得不到法律充分的保护，并且牵涉到众多的利益群体。因此，小产权房的大量存在使这一民生社会问题受到众多法学研究者和法律实务者的注意，从而研究小产权房的何去何从。然而这并不是小产权房问题成为热点的唯一原因，从改革开放就被人们注意的城乡一体化建设问题一直随着社会的发展而不断凸显，户籍制度改革的呼声也促进城乡统筹发展政策的进步，这使我国土地制度二元制的矛盾也是越发显著，而土地制度如何改革也是小产权房是否合法化和能否自由流转的关键所在，因此小产权房流转的问题也是政府十分关注的问题。 小产权房流转法律问题研究:http://www.youerw.com/faxue/lunwen_147850.html
